Streaming: no gain, no penalties

The Frosinone Court annulled a fine imposed to a web site where it’s possible to find links to download and watch movies: the Court, in fact,  determined that there is no violation of copyright if a site does not host movies directly, but only the links to click and achieve web sites where, then, you can download movies.

The simple link shown on the website, in fact, can not be considered as a genuine provision of files protected by copyright: that’s why the web site which hosts numerous links it’s not to be considered as unlawful.

It is the first time in Europe: the judge says that it is necessary to "prove a true economical gain", otherwise the closure of the site is unlawful.

There is no profit in this case because, according to the decision of the Court, there is insufficient evidence to show that the website gains are directly attributable to the hacked movies, because the links are simply shared on the sanctioned website.
