Employer's mobbing in case of harrasment by co-workers, judg. n. 74/2016, Supreme Court.

It has been established by the Supreme Courts that is configurable bullying employers where the oppressive behavior of co-workers, against an employee, it was not opposed by the employer eliminating the adverse circumstances.

In fact, it says the Supreme Court, oppressive behavior by workers is suitable to “configure mobbing where the employer is guilty remaining inert in the removal of harmful act; also the human aspect is part of the working environment in which operates the duty of protection provided by art. 2087 civil code”.
