The latest new in the field of innovative startup is the approval – on February 19^th, 2016 – of the Decree which provides the possibility to establish this type of companies trough a standard model with digital signature.

Without prejudice to the possibility to establish the company by a notarial deed, with all that this implies in terms of costs, the startup can now use a model directly fillable online. This form, together with the forms for transmission and for registration in the Company Register, will be approved by the next Directorial Decree and may be completed by the shareholders or by the appropriate Company Register’s Office, which makes the subscriptions authentic and registration effective. In this way, the innovative startup may arise simultaneously to the last signature.

This new possibility was originally foreseen from March 24^th, 2015 with the approval of the Investment Compact, which was adopted in order to simplify the procedures and to facilitate the innovative startup, but has given rise to a particularly negative reaction of the notaries. In fact, thanks to the confirmation of the new method for establishing the innovative startup, the startuppers’ world has gained his battle.
