Robberies at work: the employer must compensate the employee.

In a recent judgment, the italian Corte di Cassazione (Supreme Court) ruled that the employer's obligation to ensure the worker's integrity must be extended  to the prevention of robberies in the workplace. The employer, in fact, has a precise obligation to protect the worker's physical and mental integrity and his moral personality too (art. 2087  of the italian civil code):  this obligation, according to the Supreme Court, it's to be extended to the prevention of robberies in the workplace, in cases where the work activity makes predictable incidents of that type.

In this case (judg. n. 321, february 18th 2016) an employee of a robbed post office received a compensation for the suffered damage: non-functional cameras, windows and doors unattended, in fact, represent a violation of the employer's obligations.

Moreover, it's up to the employer to prove that he has entirely fulfilled its obligations, adopting appropriate security measures to limit the risk of demages.
