In July 2014, the Italian Justice Ministry approved the update of the Guidelines developed by Confindustria for the "construction of Organisation, Management and Control Models". As known the said Guidelines provide useful indications for the adoption of the MOG - as a lifeline for the waiver of 231's responsibility - not only to large companies or company groups, but also to PMI.
The Confindustria Working Group, in dedicating a specific section to the MOG for PMI, foresees several simplifications justified on the basis of a reduced corporate dimension and, as a consequence of this, of a lesser risk of commission of crime. Neverthless, not always what is useful can feel also appropriate and effective: are we sure that a standardized model will allow any small-medium sized businesses to comply with 231's prescriptions?
